Wat hebben de euthanasielobbyisten van Nederlandse Vereniging voor Vrijwillig Levenseinde en de controleinstantie Regionale Toetsingscommissies Euthanasie gemeen? Beiden hebben dezelfde voorzitter gehad: D66-politicus Jacob Kohnstamm. Een sterk staaltje "Wij van WC-eend adviseren WC-eend", dat toont hoezeer de toetsing van euthanasie in Nederland een wassen neus is.
Gedwongen euthanasie
Wereldwijd is er met verbazing op gereageerd: de euthanasie onder dwang van een Nederlandse vrouw. De demente dame werd door familie in bedwang gehouden terwijl een arts de dodelijke spuit zette. “Het had geen zin het haar te vragen… In haar gedrag gaf ze aan dat ze dood wilde", luidt de rechtvaardiging van de arts. Het geval is helaas niet uniek. Gedwongen euthanasie rukt op in Nederland. Reden genoeg voor Stirezo om de verantwoordelijk minister De Jonge te petitioneren om deze dwang te stoppen.
Tuchtcollege
Het Openbaar Ministerie stelt een strafrechtelijk onderzoek in naar de zaak, een mijlpaal in de Nederlandse euthanasie-geschiedenis. Ook het Regionaal Tuchtcollege voor de Gezondheidszorg in Den Haag heeft onderzoek gedaan en de arts op het matje geroepen. Het tuchtcollege is ingesteld om medische wantoestanden aan de kaak te stellen. Goed dat ze er werk van maken, zou je denken.
Slechts berisping
Maar het oordeel van het Haags tuchtcollege is boterzacht. De arts heeft verkeerd gehandeld, maar deed dat in goede wil en in samenspraak met de familie. Daarom krijgt ze van het tuchtcollege geen schorsing maar slechts een berisping. Een tik op de vingers voor het doden van een tegenstribbelend mens.
Slappe toezicht
De berisping is beter dan niets, maar tekent het slappe toezicht op euthanasie. Ernstige vergrijpen worden met de mantel van de keuzevrijheid bedekt. Ook als de bejaarde in kwestie helemaal geen duidelijke keuze had gemaakt voor de euthanasie die haar toegediend werd. Zo wordt de suïcideromantiek in stand gehouden.
"Naar eer en geweten"
Wie is verantwoordelijk voor deze permissieve euthanasiepraktijk? De collaborerende artsen, de verantwoordelijke ministers, de tuchtcollegeleden zelf. Maar bovenal Jacob Kohnstamm, D66-politicus en voormalig staatssecretaris. Toen de arts in kwestie op de vingers getikt werd, verklaarde hij tegen De Volkskrant dat deze arts "naar eer en geweten heeft gehandeld". Ze "deed wat ze moest doen".
Toetsingscommissies
Kohnstamm is niet zomaar een D66-euthanasiast. Hij is voorzitter van de Regionale Toetsingscommissies Euthanasie (RTE), de eerste instantie die euthanasieën controleert. Bij uitstek een functie die onpartijdigheid en terughoudendheid vraagt - vooral omdat regionale tuchtcolleges voor de gezondheidszorg zich baseren op toetsing van de RTE's. Kohnstamms positieve woorden over de arts die een tegenstribbelende vrouw doodde, zijn dan ook opmerkelijk.
Fanatiek lobbyist
Des te opmerkelijker is dat Kohnstamm al jarenlang een fanatiek lobbyist is voor meer euthanasie. De D66'er was van 2000 tot 2006 voorzitter van de Nederlandse Vereniging voor Vrijwillige Euthanasie (NVVE), een lobbyclub die voor verdere legalisatie van geassisteerde zelfmoord ijvert. Dat ijveren ging ver. Kohnstamm maakte zich hard voor:
- Het jagen op gewetensbezwaarde artsen die niet euthanasie willen uitvoeren. "Degene die het in zijn bolle hoofd haalt niet te verwijzen, kan rekenen op een volledige klachtprocedure."
- Het vervolgen van artsen die zich terugkomen op een eerdere toezegging om euthanasie te plegen.
- Het legaliseren van de zelfmoordpil, zodat je jezelf van kant kunt maken. Kohnstamm: "Ik vind het beneden alle peil als ik me als 96-jarige moet verhangen of voor de trein moet springen."
Christelijk protest
Toen Kohnstamm in 2016 voorgedragen werd als RTE-voorzitter, waren ChristenUnie en SGP terecht verbaasd. Tweede Kamerlid Carla Dik-Faber (CU) protesteerde: "Tweederde van de artsen ervaart druk om euthanasie uit te voeren en de NVVE werkt daar van harte aan mee."
Volgende halte
Het protest van de christelijke partijen was terecht. Kohnstamm ijvert ook als RTE-voorzitter voor meer mogelijkheden tot euthanasie. Onder zijn leiding is de RTE meer en meer het doden van wilsonbekwame, demente patiënten gaan goedkeuren. Het voornoemde geval van gedwongen euthanasie is slechts één halte verder dan halte-Kohnstamm.

"Ontoegankelijk bastion"
Ethica Berna van Baarsen schetst in Trouween onthutsend beeld van Kohnstamms regime. Zij stapte na tien jaar uit de RTE, wegens de toenemende euthanasie op wilsonbekwame patiënten. Volgens haar heeft de euthanasielobbyist van het controleorgaan een "een ontoegankelijk bastion" gemaakt, waarin morele vragen het afleggen tegen juristerij. Van Baarsen: "Ik heb te vaak meegemaakt dat (tijdrovende) ethische argumenten nauwelijks onderzocht waren als de knoop door de voorzitter werd doorgehakt."
Niet transparant
Kohnstamms RTE is allerminst transparant, klaagt Van Baarsen. De commissievergaderingen, waarin vaak diepgaande meningsverschillen zijn, worden niet genotuleerd. Van Baarsen spreekt van een richtingenstrijd tussen 'rekkelijken' en 'preciezen'. Het is evident in welk kamp Kohnstamm zit. Zijn rol in deze richtingenstrijd blijft evenwel in nevelen gehuld. Veel zaken die als 'zorgvuldig' beoordeeld worden, zijn niet te raadplegen op de RTE-website. Daardoor is de RTE een black box. Bij uitstek de omgeving waarin een geslepen politicus en gehaaide lobbyist graag opereert.
99,8% 'zorgvuldig'
Door NRC Handelsblad geconfronteerd met de kritiek van ethica Van Baarsen, vlucht Kohnstamm in a-morele juristerij: "Wij beoordelen aan de hand van de wet of artsen zorgvuldig of onzorgvuldig handelden bij een euthanasie." En het oordeel komt in wel 99,8% van de gevallen uit op 'zorgvuldig'. Een Noord-Koreaans percentage dat ernstig doet twijfelen of de RTE zélf wel zorgvuldig toetst. Een percentage dat bovendien het product lijkt van de lage lat die Kohnstamm als NVVE-voorzitter bepleitte.
Ambtenaar blijft lobbyist
Kohnstamm wist begin jaren 2000 de NVVE in de kijker te spelen met radicale voorstellen. Toen hij in 2016 de RTE ging leiden, lag terughoudendheid voor de hand. De commissie is een overheidsorgaan en moet de wet uitvoeren. De wet bepalen, dat is aan de wetgever. De wet interpreteren, dat is aan de rechter.Maar van die ambtelijke bescheidenheid wil de RTE-voorzitter niets weten. In 2017 bepleitte hij euthanasie door artsen zonder behandelrelatie met de patiënt, als ook 'behandeling' voor psychiatrische patiënten. Kohnstamm blijft op en top lobbyist, die graag de media opzoekt om voorstellen te verkopen.
"Parlement moet zich uitspreken"
Hoogleraar gezondheidsrecht Martin Buijsen hekelde het optreden van Kohnstamm: "Wat mij tegen de borst stuit is dat de toetsingcommissie bepaalt wat de betekenis van de euthanasiewet is. Zij bepalen in hun eentje of de deur wijd of juist minder wijd wordt opengezet. Niemand heeft die mensen gekozen. Ik vind dat het parlement zich moet uitspreken over de reikwijdte van de euthanasiewet en niemand anders."
Volstrekt onacceptabel
Dat een voormalig voorzitter van de euthanasielobby de chef van de Regionale Toetsingscommissies Euthanasie kan worden, en in die rol zo ontransparant en pro-euthanasie kan optreden, is volstrekt onacceptabel. Het is alsof de gewezen voorzitter van een belangenvereniging voor tabaksfabrikanten mag gaan controleren of fabrikanten wel de volksgezondheid in acht nemen. Nederland zou te klein zijn voor dit staaltje "Wij van WC-eend adviseren WC-eend", maar bij euthanasie kan het allemaal. Het zou lachwekkend zijn, als het slachtoffers van Kohnstamms activisme niet weerloze, wilsonbekwame mensen zijn, zoals de demente dame die al tegenstribbelend de dood in werd gespoten.

What do the euthanasia lobbyists of the Dutch Association for Voluntary End of Life and the Review Committee on Euthanasia have in common? Both have had the same chairman: politician Jacob Kohnstamm of D66 (the Dutch Liberal Democrats). A strong example of iudex in sua causa (‘judge in your own case’), that shows how unserious the reviewing of euthanasia in the Netherlands actually is.
Forced euthanasia
Worldwide there has been an astonishing response: euthanasia under pressure for a Dutch woman. The demented lady was held in check by her family while a doctor put the deadly syringe. "It did not make sense to ask her ... In her behaviour she indicated that she wanted to die", is the doctor's justification. The case is unfortunately not unique. Forced euthanasia is gaining ground in the Netherlands. Reason enough for Stirezo to petition responsible minister De Jonge to stop this coercion.
Disciplinary Court
The Public Prosecution Service is conducting a criminal investigation into the case, a milestone in Dutch euthanasia history. The Regional Disciplinary College for Healthcare in The Hague also conducted research and called the doctor to account. This disciplinary committee is set up to expose medical abuses. That is a good thing, you might think, they will certainly sort it out, .
Only reprimand
But the judgment of the The Hague disciplinary court is so soft. In their vision, the doctor acted wrongly, but did so in good will and in consultation with the family. That is why she receives no suspension from the disciplinary court, but only a reprimand. A tap on the fingers for killing a struggling human being.
Slack supervision
The reprimand is better than nothing, but it shows how weak the supervision of euthanasia in The Netherlands really is. Serious offenses are covered with the cloak of ‘freedom of choice’. Even if the elderly person in question had not made a clear choice for the euthanasia that was administered to her. This is how the suicide romance is maintained.
'In good conscience'
Who is responsible for this permissive euthanasia practice? The collaborating doctors, the responsible ministers, the disciplinary members themselves. But above all Jacob Kohnstamm, D66 politician and former secretary of state. When the doctor in question was corrected, he told De Volkskrant that this doctor "acted in good conscience". She "did what she had to do".
Review committees
Kohnstamm is not just a D66 euthanasiast. He is chairman of the Regional Review Committees on Euthanasia (RTE), the first body that controls euthanasia. An outstanding function that requires impartiality and restraint - especially because regional disciplinary bodies for health care rely on testing the RTE's. Kohnstamm's positive words about the doctor who killed a struggling woman are therefore remarkable.
Fanatic lobbyist
The more remarkable is that Kohnstamm has been a fanatical lobbyist for more euthanasia for many years. He was from 2000 to 2006 chairman of the Dutch Association for Voluntary Euthanasia (NVVE), a lobby club that works for further legalization of assisted suicide. Kohnstamm made a firm stand for:
- The hunting of conscientious objectors who do not want to perform euthanasia. "The person who gets it in his stupid head not to refer to another doctor, may count on a complete complaint procedure."
- The prosecution of doctors who come back on an earlier commitment to commit euthanasia.
- Legalizing the suicide pill, so that you can kill yourself easily, whenever you want. Kohnstamm: "I find it below all standards if I have to hang myself as a 96-year-old or have to jump before the train."
Christian protest
When Kohnstamm was nominated as RTE chairman in 2016, ChristenUnie and SGP, the small Christian parties in de Dutch parliament. were rightly surprised. Member of Parliament Carla Dik-Faber (CU) protested: "Two-thirds of the doctors experience pressure to carry out euthanasia and the NVVE support this wholeheartedly."
Next stop
The protest of the Christian parties was justified. Also as an RTE chairman Kohnstamm keeps pressing for more possibilities for euthanasia. Under his leadership, the RTE is increasingly adopting the killing of incompetent, demented patients. The aforementioned case of forced euthanasia is only one stop away from the Kohnstamm stop.
'Inaccessible bastion'
Berna van Baarsen, expert in medical ethics, paints a disconcerting image of Kohnstamm's regime in Trouw. She resigned from the RTE after ten years, due to the increasing euthanasia of incapacitated patients. According to her, the former lobbyist for euthanasia has made the control body into an "inaccessible bastion", in which legal niceties have taken the place of moral questions. Van Baarsen: "I have experienced too often that (time-consuming) ethical arguments were hardly investigated, when the president was already coming to the conclusion."
Not transparent
Kohnstamm's RTE is by no means transparent, Van Baarsen complains. The committee meetings, in which there are often profound differences of opinion, are not recorded. Van Baarsen speaks of a struggle between ‘flexible' and 'precise' members. It is evident which camp is Kohnstamm’s. However, his role in this struggle remains shrouded in mystery. Many cases that are assessed as 'careful', cannot be consulted on the RTE website. As a result, the RTE is a black box: the ideal environment for a crafty politician and a cunning lobbyist to operate in.
99.8% 'careful'
Confronted by NRC Handelsblad with the ethical criticism of Van Baarsen, Kohnstamm fled in a-moral legal arguments: "We judge by law whether doctors acted carefully or negligently in euthanasia." And the verdictis is in: 99.8% of Dutch euthanasia cases are 'careful'. A North Korean percentage that raises seriously doubts whether the RTE reviews itself carefully. A percentage that also appears to be the product of the low standards that Kohnstamm advocated as NVVE chairman.
Official remains a lobbyist
Kohnstamm knew in the early 2000s to get the NVVE into the spotlight with radical proposals. When he started leading the RTE in 2016, excercising restraint was the obvious thing to do. The committee is after all a government body and has to implement the law. Determining the law is up to the legislator. Interpreting the law is up to the judge. But the RTE president seems not to understand the modesty that becomes him. In 2017 he advocated euthanasia by doctors who do not have a treatment relationship with the patient, as well as 'treatment' for psychiatric patients. Kohnstamm remains a top lobbyist, who likes to appear in the media to sell his proposals.
'Parliament must speak out'
Professor of health law Martin Buijsen denounced the performance of Kohnstamm: "It nauseates me that the review committee determines what the meaning of the euthanasia law is. They determine themselves whether the door [for euthanasia] is opened wider or less wide. Nobody has chosen these people. I think that it is up to parliament to give its opinion on the scope of the euthanasia law, and nobody else. "
Totally unacceptable
The fact that a former chairman of the euthanasia lobby is allowed to become the president of the Regional Review Committees on Euthanasia, and is able to act so untransparantly and pro-euthanasia, is completely unacceptable. It is as if the former chairman of a tobacco interest group is allowed to check what manufacturers have to do in respect to public health. But in case of euthanasia, we see it happen before our eyes. This story could seeem funny and ridiculous, but remember that it is all about life or death, and that the victims of Kohnstam's activism are defenceless and incapacitated people, such as the demented lady, who resisted but was killed against her will.
